Terms of Service

Effective Date: March 30, 2026

Overview

These Terms of Service govern all services provided by Fivision Webworks. By engaging our services, the client agrees to these terms.

Fivision Webworks provides services including website design, WordPress development, ecommerce development, Webflow and Framer websites, automation systems, Go High Level (GHL), and related digital solutions.

Scope of Work

All work will be defined in a written proposal, quotation, or agreement before the project begins.

Any work outside the agreed scope will be treated as additional work and may result in extra charges and timeline adjustments.

Project Phases

All projects are divided into two distinct phases:

Design Phase

This includes UI/UX design, layout, structure, and visual direction.

  • Includes a limited number of revision rounds (as defined in the proposal)
  • Focused on visual and structural approval

Development Phase

This includes building, coding, and implementing the approved design.

  • Begins only after design approval
  • Focused on functionality and implementation

Design Approval and Lock

Once the client approves the design, it is considered final and locked.

Any changes requested after approval will be treated as a new scope of work, which may incur additional costs and timeline extensions.

Timeline and Delays

Project timelines are estimates and depend on client responsiveness and content delivery.

If the Design Phase exceeds its allocated timeframe due to:

  • Delayed feedback
  • Excessive revisions
  • Changes in direction

Then:

  • The Development Phase timeline will be adjusted accordingly
  • Additional fees may apply

Fivision Webworks reserves the right to pause or reschedule the project if delays occur.

Client Responsibilities

The client agrees to:

  • Provide all necessary content, assets, and access credentials
  • Review and provide feedback within 2–3 business days
  • Ensure accuracy of all provided information

Delays in client response may result in timeline changes.

Revisions

Projects include a limited number of revisions as defined in the agreement.

Additional revisions beyond this limit, or major changes in direction, will be considered out-of-scope and billed accordingly.

Payments

A deposit is required before work begins.

Remaining balances are due based on milestones or upon project completion.

Fivision Webworks reserves the right to:

  • Pause work for unpaid invoices
  • Withhold final deliverables until full payment is received

All payments are non-refundable.

Third-Party Services

Projects may involve third-party tools, platforms, or services such as hosting providers, plugins, APIs, Webflow, Framer, or GHL.

Fivision Webworks is not responsible for:

  • Third-party downtime or failures
  • Pricing changes
  • Platform limitations or updates

Support and Maintenance

Post-launch support is not included unless explicitly stated.

Ongoing maintenance, updates, or support require a separate agreement or subscription.

Intellectual Property

Upon full payment, the client will own the final deliverables.

Fivision Webworks retains the right to showcase completed work in its portfolio unless otherwise agreed.

Termination

Either party may terminate the project with written notice.

In such cases:

  • All payments made are non-refundable
  • Work completed up to termination will be billed

Limitation of Liability

Fivision Webworks shall not be liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities.

Project Suspension

If the client becomes unresponsive for more than 14 days, the project may be placed on hold.

Reactivation of the project may require:

  • Timeline rescheduling
  • Additional fees

Force Majeure

Fivision Webworks shall not be held responsible for delays or failure due to events beyond reasonable control, including natural disasters, internet outages, or government actions.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.
